    Agreement to Terms

    These Terms of Service ("Terms") govern your use of the services provided by Homets Services, LLC ("Home+ Air and Heat," "we," "us," or "our"). By accessing our website or using our HVAC services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

    Services Provided

    Home+ Air and Heat provides residential and commercial HVAC services in Nassau County, Long Island, including:

    • Heating system installation, repair, and maintenance
    • Cooling system installation, repair, and maintenance
    • Air quality solutions and indoor air purification
    • Emergency HVAC repairs (24/7 availability)
    • Smart thermostat installation and configuration
    • Water heater services and mini-split systems

    Appointment Scheduling and Cancellation

    Scheduling

    Appointments can be scheduled online through our website, by phone, or via email. We will confirm your appointment within 24 hours of your request. Service times are estimated and may vary based on technician availability and unforeseen circumstances.

    Cancellation Policy

    If you need to cancel or reschedule an appointment, please provide at least 24 hours' notice. Cancellations made with less than 24 hours' notice may be subject to a cancellation fee of up to $75.

    Pricing and Payment

    Service Fees

    All service fees and estimates are provided upfront before work begins. Prices may vary based on the complexity of the job, parts required, and service urgency. Emergency services are provided at standard rates with no overtime fees.

    Payment Terms

    Payment is due upon completion of services unless other arrangements have been made. We accept:

    • Credit and debit cards (Visa, MasterCard, American Express, Discover)
    • Cash and checks
    • Financing options (subject to credit approval)

    Late payments may be subject to a finance charge of 1.5% per month (18% annually) on the outstanding balance.

    Warranties and Guarantees

    Service Guarantee

    We stand behind our work. All labor is guaranteed for 90 days from the date of service. If you experience issues with our workmanship within this period, we will return to address the problem at no additional charge.

    Parts Warranty

    Parts and equipment are covered by the manufacturer's warranty. Warranty periods vary by manufacturer and product. We will assist you with warranty claims and service as needed.

    Installation Warranty

    New HVAC system installations include a 1-year labor warranty in addition to the manufacturer's equipment warranty. Extended warranty options may be available for purchase.

    Customer Responsibilities

    As a customer, you agree to:

    • Provide accurate information about your HVAC system and service needs
    • Ensure safe access to all equipment requiring service
    • Be present or designate an authorized representative during service calls
    • Maintain your HVAC system according to manufacturer recommendations
    • Notify us promptly of any concerns or issues with completed work
    • Clear the work area of personal belongings and valuables

    Limitation of Liability

    Home+ Air and Heat shall not be liable for any indirect, incidental, special, or consequential damages arising from our services, including but not limited to loss of profits, data, or use. Our total liability shall not exceed the amount paid for the specific service in question. This limitation does not apply to damages caused by gross negligence or willful misconduct.

    Emergency Services

    Our 24/7 emergency HVAC service provides rapid response for heating and cooling emergencies. We aim for a 90-minute or less response time for emergency calls. Emergency service is provided at our standard rates with no overtime fees. However, emergency calls require immediate payment upon completion of service.

    Permits and Approvals

    When required, we will obtain necessary permits for HVAC installations and major repairs. Permit costs are the responsibility of the customer and will be included in the final invoice. You are responsible for obtaining any homeowner association approvals or landlord permissions required for the work.

    Intellectual Property

    All content on our website, including text, graphics, logos, images, and software, is the property of Homets Services, LLC and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our express written permission.

    SMS/Text Messaging Terms

    By opting in to SMS messages from Homets Services, LLC, you agree to the following terms regarding our text messaging program.

    Description of SMS Use Cases

    When you opt in, Homets Services, LLC may send you SMS messages related to:

    • Service request confirmations and updates
    • Appointment scheduling, reminders, and confirmations
    • Technician arrival and en-route notifications
    • Customer support responses and follow-ups
    • Service completion summaries

    We will never use SMS to send marketing promotions, advertisements, or third-party offers. SMS messages are limited to transactional and service-related communications only.

    Opt-Out Instructions

    You may opt out of receiving SMS messages at any time by replying STOP to any message you receive from us. Upon receiving your STOP request, we will send a one-time confirmation message and no further SMS messages will be sent. You may also opt out by contacting us at (516) 259-1191 or info@hometsair.com.     Message Frequency & Data Rates

    Message frequency may vary depending on your service activity. Typical usage is 1–5 messages per service request. Message and data rates may apply depending on your mobile carrier and plan. Homets Services, LLC is not responsible for any charges incurred from your wireless carrier for receiving SMS messages.

    Carrier Liability Disclaimer

    Wireless carriers (including but not limited to AT&T, T-Mobile, Verizon, and others) are not liable for delayed or undelivered messages. Homets Services, LLC makes no guarantees regarding the delivery, timeliness, or accuracy of any SMS messages. Service availability may be affected by your carrier's coverage area, network conditions, or device compatibility.

    Age Restriction

    You must be at least 18 years of age to opt in to our SMS messaging program. By providing your phone number and consenting to receive text messages, you confirm that you are 18 years of age or older.

    Consent & Third-Party Sharing

    SMS consent is not a condition of purchasing any goods or services from Homets Services, LLC. Your mobile opt-in data and consent will not be sold, rented, or shared with any third parties or affiliates for their marketing or promotional purposes.     Dispute Resolution

    Any disputes arising from these Terms or our services shall first be addressed through good-faith negotiation. If a resolution cannot be reached, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, with proceedings held in Nassau County, New York. Each party shall bear its own costs and attorney fees.

    Governing Law

    These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any legal action or proceeding shall be brought exclusively in the courts of Nassau County, New York.

    Changes to Terms

    We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes your acceptance of the revised Terms. We recommend reviewing these Terms periodically.
